For starters, it almost goes without saying that medical records are crucial. After all, a medical malpractice case involves allegations that often state that a medical professional made some kind of mistake or failed to take action when it was necessary. Documentation of the actual acts or omissions of the medical professionals is a paper trail that can lead a discerning eye to the point where the mistake in question was made.

It is important not to forget that "medical records" refers not just to physical health records, but mental health records as well. When a person suffers from a medical malpractice incident, it is not uncommon for there to be a subsequent impact on the state of the person's mental health. If such treatment was sought, the costs for that treatment may be an important part of the medical malpractice case.

Copies of all medical bills will be crucial if the case gets to the point where the victim needs to prove the financial aspect of damages being sought. In many cases, the victim is the only person with these copies, outside of the medical provider who issued the bills.
